SOME HIGHLIGHTS OF THE FOLLOWING NEW LAWS FOR 2005

NEW RESTRICTIONS ON LANDLORDS DEMANDING
CASH ONLY FOR RENT OR SECURITY DEPOSIT PAYMENT

A landlord may not demand that rent or a security deposit  must be paid in cash only unless that tenant has paid the landlord by a check which was returned by the bank (i.e. NSF or stop payment)  If the lease has a cash payment term and the tenant has tendered a check returned as unpaid, the landlord may serve a notice on the tenant explaining that they are now required to pay by cash only for a specified period (not more than three months)

10% RENT INCREASE LAW STAYS IN EFFECT

The law that required a 60 day notice for rent increases of over 10% (in month to month tenancies) was to expire ("sunset provision").  That expiration was cancelled so this 60 day rent increase law will remain in effect.
